On October 23, 2020 - two Daytona Beach police officers failed to remain within the law - regarding their traffic stop of Kary Jarvis. (see police video for particulars -->)
On that day - the police were so far outside the law - apparently - according to local Circuit Court Judge Sandra Upchurch (see below right - Judge Upchurch's ruling) - Mr. Jarvis was within his rights to leave the scene of the traffic stop - as he dragged the two police officers some thirty (30) yards down the road.

Constitutional Principles
In short - Judge Upchurch's ruling suppressed much of the prosecution's evidence in the Jarvis case - due to the fact that the two police officers violated Mr. Jarvis' fourth amendment right to unlawful search and seizure.
Without this evidence - the prosecution no longer had a prosecutable case against Mr. Jarvis.
Initially, the State Attorney appealed Judge Upchurch's ruling to the 5th District Court of Appeal - but shortly later they abandoned their appeal - and opted to drop their criminal prosecution of Mr. Jarvis.

Given the legal principle of stare decisis - Judge Upchurch's ruling in the Jarvis case - may have standing in the on-going criminal prosecution of Iyanna Rollins.
